Introduction & Acceptance of Terms
Welcome to DigiStackDev (“we,” “us,” or “our”). By visiting our website or using any of our services, you agree to these Terms and Conditions. They form a legally binding agreement between you (“Client”) and DigiStackDev. If you do not agree with any part of these terms, please do not use our services. We may update these terms from time to time, and continuing to use our services means you accept the updated version. You confirm that you are at least 18 years old and legally able to enter into this agreement.
Description of Services
DigiStackDev provides digital services such as full-stack web development, SEO optimisation, SaaS solutions, and custom business email services. The scope, deliverables, and timelines for each service are explained on our website or set out in a written proposal agreed with you. We do our best to keep all service descriptions accurate, though occasional updates or minor errors may occur. We reserve the right to improve, modify, pause, or discontinue any part of our services at any time. Any new features or tools introduced will also be covered by these Terms and Conditions.
Your Responsibilities & Account Security
Some services may require you to create an account or share certain information. You agree to provide accurate and up-to-date details and to keep them current. You are responsible for keeping your login credentials secure and for all activity carried out through your account. If you suspect unauthorised access, you must inform us immediately. We are not responsible for losses resulting from failure to protect your account details. You agree to use our services only for lawful and authorised purposes.
Payments, Fees & Billing
All prices are listed in US Dollars (USD) unless stated otherwise. Payments are processed securely through Stripe, our authorised payment provider. For subscription services, you authorise automatic recurring charges based on your selected plan. Custom development work may require an upfront deposit, with remaining payments due upon completion or agreed milestones. You agree to provide accurate billing information for all purchases. Late or failed payments may result in suspension or termination of services. We may update our pricing with reasonable notice.
Refunds & Cancellations
Our refund policy: For custom development work, deposits are generally non-refundable once work has begun, as resources are committed immediately. Subscription services may be cancelled at any time, but access will continue until the end of the current billing period. We do not offer partial refunds for unused time. If you believe a billing error has occurred or we have failed to deliver an agreed service, please contact us at info@digistackdev.com. All refund requests are reviewed on a case-by-case basis.
Intellectual Property Rights
Once all fees have been paid in full, you are granted a non-exclusive, worldwide, permanent licence to use the final deliverables for your business. DigiStackDev retains ownership of any pre-existing tools, frameworks, or code used in creating the work. You confirm that any materials you provide do not infringe on third-party rights and agree to take responsibility for them. You agree to protect us from claims arising from content you supply. Unless otherwise agreed, we may showcase completed projects in our portfolio.
Limitation of Liability
To the fullest extent allowed by law, DigiStackDev is not responsible for indirect or consequential losses, including loss of profits, data, or business opportunities. This applies whether the loss arises from use of, or inability to use, our services. Our total liability for any claim related to a service is limited to the amount you paid for that service in the 12 months before the issue arose. This applies regardless of the legal basis of the claim.
